These Terms of Service form a legally binding agreement between you ("you," "Realtor," or "Customer") and WINGMAN governing your access to and use of the WINGMAN platform at wingmanforce.com and any related services (the "Service"). By accessing or using the Service, you agree to be bound by these Terms. You must be at least 18 years of age to use the Service.
WINGMAN is an AI-powered real estate sales coaching platform. The Service listens to live real estate sales conversations through your computer's microphone, transcribes spoken words into text using your browser's native Web Speech API, and uses artificial intelligence to generate bilingual teleprompter scripts to assist real estate professionals during sales calls.
AI Disclosure Duty. Some jurisdictions require you to disclose to call participants that you are using artificial intelligence, call monitoring, or transcription technology. You are solely responsible for determining whether such disclosure obligations apply to your calls and for making all legally required disclosures. By using WINGMAN, you represent and warrant that you will make every disclosure and obtain every consent required by the laws applicable to each call.
WINGMAN is offered at a monthly subscription rate announced at launch. A 7-day free trial is available for new subscribers. After the trial period, your subscription will automatically renew monthly unless cancelled.
Your subscription automatically renews at the end of each billing period. You authorize WINGMAN to charge your payment method on file for each renewal period until you cancel.
All fees are non-refundable except as expressly required by applicable law.
AI-generated coaching scripts are suggestions only. WINGMAN makes no representation that any script will be effective, appropriate, legal, or suitable for any particular client, prospect, or situation. You are solely responsible for all statements you make to clients and prospects. WINGMAN does not guarantee that using its scripts will result in any particular sales outcome.
No Professional Advice. AI-generated output does not constitute legal, tax, financial, investment, appraisal, or other professional advice. WINGMAN is a communication-coaching tool for licensed professionals; you remain solely responsible for compliance with your licensing obligations, MLS rules, fair-housing laws, and all real estate regulations.
WINGMAN, its technology, platform, system prompt, AI methodology, training data, scripts, and branding are the exclusive property of WINGMAN and its licensors. WINGMAN's methodology, sources, AI training, and operational intelligence are classified and proprietary and will never be disclosed.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WINGMAN DISCLAIMS ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WINGMAN DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.
TO THE FULLEST EXTENT PERMITTED BY LAW, WINGMAN AND ITS OFFICERS, DIRECTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. WINGMAN'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO WINGMAN IN THE TWELVE MONTHS PRIOR TO THE CLAIM.
You agree to indemnify, defend, and hold harmless WINGMAN and its officers, directors, employees, and agents from and against any claims arising out of: (1) your use of the Service; (2) your violation of these Terms; (3) your violation of any applicable law including wiretapping and recording laws; (4) any statements you make on any call using WINGMAN; or (5) any claim by a third party arising from your use of AI-generated scripts.
Informal Resolution First. Before initiating arbitration, you agree to send a written Notice of Dispute to support@wingmanforce.com describing the dispute and the relief sought, and to negotiate in good faith with WINGMAN for at least 30 days after the notice is received. Arbitration may be initiated only if the dispute is not resolved within that period.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in the State of Florida before a single arbitrator under the rules of the American Arbitration Association. ALL CLAIMS MUST BE BROUGHT ON AN INDIVIDUAL BASIS. YOU MAY NOT PARTICIPATE IN ANY CLASS ACTION.
These Terms are governed by the laws of the State of Florida without regard to conflicts of law principles. Subject to the arbitration agreement above, all disputes shall be resolved in the state or federal courts located in Miami-Dade County, Florida.
